Will of H. H. Mathew

MATHEW, NOBLE, MARTIN, SEAL, NICOLA, CARTER, BURGESS, TURNEY, JORDUN

Know All Men by These Presents:

That I, H.H. Mathew, of Fairfield, Iowa do hereby make and declare this to be my Last Will and Testament, and in so doing I do now revoke and Wills heretofore made by me at any time, that is to say:

1. I nominate and appoint my friend, Lincoln Noble, as the Executor of this my Last Will and Testament, and without bond, and I do direct him first to pay all of my just debts, including the cost of my last sickness and burial, and subject thereto:

2. Having upon the date of the execution of this Will likewise executed a deed for my certain homestead property, to-wit: The North half of the West half of Block Seventy-five (75) of Centennial Addition to the City of Fairfield, Iowa, to my nephew, Oscar S. Martin, and having deposited said deed in escrow with the First National Bank in Fairfield, Iowa, to be delivered to my said nephew upon my death, I do now hereby ratify and confirm said deed and do likewise by this Will give, devise and bequeath said real estate just described to my said nephew, Oscar S. Martin.

3. I give and bequeath to Mrs. A.W. Seal of Wellington, Kansas, the sum of One Thousand ($1000.00) Dollars.

4. I give and bequeath to T.W. Mathew, an adopted son, of Wellington, Kansas, the sum of Four Hundred ($400.00) Dollars.

5. I give and bequeath to Mabel Mathew the sum of Two Hundred ($200.00) Dollars.

6. I give and bequeath to Charles Nicola of Washington County, Iowa, the sum of Fifty ($50.00) Dollars.

7. I give and bequeath to Mrs. Charles Nicola the sum of Fifty ($50.00) Dollars.

8. I give and bequeath to Earl Nicola the sum of Fifty ($50.00)Dollars.

9. I give and bequeath to Mrs. Earl Nicola the sum of Fifty ($50.00) Dollars.

10. I give and bequeath to Arthur Nicola the sum of Fifty ($50.00) Dollars.

11. I give and bequeath to Mrs. Arthur Nicola, the sum of Fifty ($50.00) Dollars.

12. I direct my Executor herein named from my estate to pay the sum of Fifty ($50.00) Dollars each to the four children no born to Arthur Nicola, to-wit:
Fifty ($50.00) Dollars to his son, Richard Nicola.
Fifty ($50.00) Dollars to his son, Wayne Nicola.
Fifty ($50.00) Dollars to his daughter, Katherine Nicola.
and Fifty ($50.00) Dollars to the youngest child whose name I do not now recall.

13. I give and bequeath to Jennie Burgess of Bloomfield, Iowa, the sum of Two Hundred ($200.00) Dollars.

14. I give and bequeath to Lincoln Noble in trust for Ellsworth Turney the sum of One Hundred ($100.00) Dollars. The said Lincoln Noble shall be relieved from giving bond and likewise making reports as to the Administration of this trust and is hereby authorized to pay out for the benefit and comfort of Ellsworth Turney such sum and in such amounts and at such times as he may deem beneficial and helpful to my friend, Ellsworth Turney, until the full amount is distributed.

15. I do give, devise, and bequeath the residue and remainder of my estate, wherever the samy may be situate, to Mary Martin, the wife of Oscar S. Martin.

In Witness Whereof, I have hereunto affixed my signatur3e to this my Last Will and Testament on the the 21st day of March, 1936.

State of Iowa, Jefferson County, ss:
We the undersigned, hereby certify that the testator, H.H. Mathew, did on this the 21st day of March, 1936, sign the foregoing instrument in our presence as and for his Last Will and Testament, and that we have at his request and in his presence and in the presence of each other have hereunto affixed our signatures as subscribing witnesses.

Know All Men by These Presents:
That I, H.H. Mathew, of Fairfield, Iowa, do now make this Codicil to my Will heretofore executed on the 21st day of March, 1936:

In the Third Paragraph of said Will wherein I give and bequeath to Mrs. W.A. Seal of Wellington, Kansas, the sum of One Thousand Dollars, I do now strike out therefrom the words "One Thousand" and insert in lieu thereof the words "Seven Hundred"; and in all other respects I do not confirm and establish said Will so made.

In witness Whereof, I hae hereunto affixed my signature on this the 9th day of April, 1936.
