Ida P. CARY vs. Charles BAUGHN - Court Case

The District Court, at its June session was largely occupied
with criminal business. The most important civil case
was that of Ida P. CARY vs. Charles BAUGHN, involving
the title to a large amount of valuable property in the
eastern part of the City of Council Bluffs. The plaintiff
claimed the property as the only daughter and heir at
law of Stephen T. CARY, who died in 1855. The defendant
derived his title from the widow of CARY, who claimed
it under a Will in which all property of the deceased
was devised to her; but the Will was executed in the State
of Indiana, before the property in dispute had been acquired,
and before the birth of the plaintiff. Testimony was introduced
on the trial to show that the Will had been re-published
just previous to the Testator's death, and the jury gave
a verdict for the defendant, which, however, was set aside
by the supereme court.
