THE MASONS ACQUIT SCHULTZ - Storm Lake Man, Who was Shot
by Editor Smith, Is Cleared.
Storm Lake, Io., March 25Special: H. F. Schultz,
who was shot and seriously wounded by A. A. Smith on January 21,
was tried before the Alta Masonic Lodge on charges brought by
Smith. The charge was practically assault with intent to
commit rape. Attorney F. F. Faville, of Storm Lake, was
counsel for Smith, and James DeLand, of Storm Lake and F. H.
Helsell, of Sioux Rapids, represented Schultz, who was present
with ten witnesses. Smith was at Alta, but did not attend the
proceedings. His counsel asked that the lodge trial of Schultz be
postponed until after Smiths trial in the district court on
the charge of attempting to murder Schultz, on the ground
substantially that a tyrial of the matter now would expose Smiths
defense to the charge in court. The postponement was not granted.
The prosecution declined to introduce any testimony and Schultz
was acquitted.
