THE FIRST DAY
The Legal Machinery Begins to Grind
The first day of the district court was not of overwhelming interest, and
was in session but a couple of hours. Sheriff PUTNAM surprised his host of
friends by appearing in the court room carefully wrapped up and he opened
court with much rigor as if he hand not just gone through a seige of
pneumonia and was 50 pounds lighter than a month ago. He will not do much
work which will fall on the capable shoulders of his deputy, A.W. MILLER,
assisted by Sheriffs PANGBORN and LEHEW.
The first thing that came up was the case of DUGDALE vs MEHLER. Judge BABB
stated to the court that the mayor and city council were in contempt as the
writ of interarum had not been obeyed, the city clerk being the only one of
the respondendents who had obeyed the mandate of the Judge. City Solicitor
T.M. McADAM arose to explain, when J.C. McCOLD whom it appears had been
retained to defend the city spoke up and wanted the case postponed. Judge
BABB demanded an instant hearing, and the matter was compromised by an order
of the court giving those in contempt until 9 o'clock this morning to answer
the writ.
The next matter was the impanelling of the Grand Jury, a matter that
appeared to be of absorbing interest to the spectators in as much as the
jury would investigate the town's now famous libel cases of which Dr. J.O.
BALL is the prosecuting witness. The following is the Grand Jury: C.F.
SPEARMAN, Jackson twp; A.L. BROOKS, city; John MOORE, Marion; Henry ECKEY,
Canaan; Wm. LEE Sr., New London; Simon DALLNER, Tippecanoe and Samuel HULME,
Jefferson. Judge SMYTH appointed C.F. SPEARMAN foreman and A.M. VANALLEN
clerk. States Atrorney KOPP then read a chapter on the duties of the Grand
Jury and Judge SMYTH gave them some additional enlightenment on their
peculiar and important duties.....
