McClenahan to Fight Removal
Des Moines, Ia., Dec 1 - Superintendent of Public
Instruction P.E. McClenahan today indicated that he may oppose
the action of the state executive council in issuing a
certificate of election entitling Miss May E. Francis, superintendent-elect,
to take office on January 2. Mc McClenahan holds a certificate
stating that his term expires July 1, 1923.
The state executive council based its action in giving Miss
Francis her certificate of election upon an opinion rendered by
Attorney General Ben J. Gibson. "Certainly one certificate
is as good as another," Mr. McClenahan said today.
"Attorney General Gibson's opinions are not the law until
they have been passed upon by the courts," he added.
Confusion over the expiration of the incumbent's term and the
seating of the new superintendent arose over repeal of the
statute making the office an appointive position and a conflict
in the present statute's designation of the end of the term of
office.
Mr. McClenehan said he had not yet definitely decided what his
probable course of action will be with respect to yielding his
office to Miss Francis.
Iowan Meets Death in Auto Accident
Fort Dodge, Ia., Dec. 1 - Frank Eddy, 35 years old, an
automobile salesman, employed by the Mansfield Motor company, of
this city, died yesterday in a hospital in Sanborn, Minn.,
following an accident Wednesday night in which he received a
broken neck. His car was struck by a box car being switched on a
railroad crossing. Eddy has made his home in Estherville for the
past eight months. He was commissioned in the aviation corps
during the world war. He leaves a widow and a daughter eight
years old.
