Mt. Pleasant News – January 4, 1945  

Marriage License Issued: A marriage license was issued at the courthouse today to Merle Max Linder, 222, New London and Wanda Arlene Ostermeier, 21, Winfield.  

William and Grace Price have given a deed to Fred M. Crawford for a Winfield property, according to records at the courthouse. Consideration is given as $2,000.  

 

December 3, 1945 – Mt. Pleasant News

George Dalton Tyner was granted a divorce from Willie Thelma Tyner by Judge E.O. Newell in court here Saturday morning. They were married July 21, 1943 and lived together for a few weeks according to the petition. Custody of the minor child, Sylvia Sue, was given to the defendant as requested in the plaintiff’s petition.

TWO WILLS ADMITTED TO PROBATE

Two wills were admitted to probate at the courthouse here Monday.

L. R. Carter left his estate to his wife, Josephine, who also was named executrix. The will made April 1, 1944, was witnessed by R. S. and Ben A. Galer.

Gust Anderson provided in his will that his estate be converted to cash and divided into fifths, one-fifth to each of the four children, A.M., A.B., and Paul E. Anderson and Effie Lund, and the other fifth to the three grandchildren, children of Frank Anderson.

MRS. LAURA KITCHEN WILL IS ADMITTED  

The last will and testament of Laura Kitchen has been admitted to probate and according to the terms of the will her property was left to her children and Charles C. Kitchen was name executor.  

The children are Margaret Hilsabeck, Ruth Rose, Carl W. Kitchen, Edward N. Kitchen, William D. Kitchen  and Charles C. Kitchen.  

The will was drawn up July 23, 1934.

Two Wills Are Admitted to Probate  

Two wills have been admitted to probate at the courthouse.  

According to the last will and testament of Emma Gladd, Winfield, all her property was bequeathed to a niece, Effie L. Larson, and a nephew, Bert A. Gladd. The will was drawn up January 11, 1943.  

The will of A. R. Ross, Winfield, left all his property to his wife, Edna P. Ross. The will was made May 29, 1948.

Will Admitted:  The last will and testament of Harvey Selburg has been admitted to probate and according to the terms of the will, all his property was left to his sister, Carrie E. Selburg Aylward.  

A niece, Ionia Len, was appointed executrix. The will was drawn up November 22, 1949.

WILL ADMITTED  

The last will and testament of L. R. Rinker has been admitted to probate and according to the terms of the will, all his property was left to his two sisters, Eva B. Allen and Mrs. Wilma Brent, and to his niece, Vivian Allen Zehr.  

Vivian Allen Zehr was appointed executrix for the will which was drawn up August 4, 1949.

SUIT FOR $1,392 AGAINST DOCTOR

Mrs. Emma Richenberger has filed a petition against Dr. W. R. Hayman in the clerk’s office at the courthouse asking for $1,392.

The petitions stated that the plaintiff claimed Dr. Hayman, a chiropodist, carelessly, negligently, and skillfully removed a corn from Mrs. Richenberger’s foot and the wound became infected and gangrene set in. As a result, the plaintiff had to employ the services of a medical physician in order to avoid amputation of the foot, the petition states. She claimed she was in Sacred Heart Hospital in Ft. Madison for 27 days being treated. She is asking that the $392 spent for treatments and medical an surgical attention be awarded her and an additional $1000 be awarded her for pain and suffering and permanent injury.

DIVORCE PETITION FILED WITH CLERK

A petition for divorce has been filed at the clerk’s office in the courthouse by Helen Bouge against Harold Bouge on the grounds of cruel and inhuman treatment.

The couple was married in Burlington December 31, 1945 and lived together until May 9, 1948. The plaintiff also asks for the custody of two minor children and than an automobile be set aside for her.

A petition for divorce has been filed in the clerk’s office at the courthouse by Dorothy. Messer against Charles E. Messer on grounds of cruel and inhuman treatment.

The couple was married at Kahoka, Missouri August 19, 1946 and lived together until June 12, 1950.

The plaintiff asks customer of three minor children, one by a previous marriage.

TWO WILLS ARE ADMITTED TO PROBATE

Two wills were admitted to probate at the courthouse today. Ida Miller left her estate to four daughters, Ada Leichty, Beulah Roth, Mayme Diers, and Velma Roth. William Liechty was named executor and witnessed by A.A. Jackson and Melvin Roth.  

Mary Eicher left her estate to her sister, Katie Eicher, who was also named executrix. The will made November 16, 1935 was witnessed by Hazel M. Eicher and Edward C. Eicher.  

DIVORCE GRANTED

Henry Noe was granted a divorce from Clara Noe in court here today by Judge Paul H. McCoid. She was restored to her former name of Clara Smith.

Mt. Pleasant News - May 2, 1945

TWO DIVORCE PETITIONS FILED

Two divorce petitions have been filed with the clerk of the court.  

Frances Appel is seeking a divorce from Harold Appel and asks for the restoration of her name of Frances Simmons. Cruel and inhuman treatment is charged in the petition which states the couple was married at Memphis , Missouri on August 24, 1942 and lived together until March 28, 1945.  

Pearl I. Cochran asks that she be granted a divorce from Vaun W. Cochran and that she be given custody of the six children ranging in age from14 years down to 3 years. She charges cruel and inhuman treatment and further sets out in the petition that he was abusive. They were married in Naperville , Illinois on May 1, 1930 and lived together until February 13, 1945. She asks for an injunction prohibiting the defendant from molesting her or the family and excluding him from the home. She also requests a writ of attachment on certain property and alimony. They have property here on East Madison and some farm land in Madison County is involved.

SUIT FOR DIVORCE FILED WITH CLERK

Raymond C. Eichenauer filed suit for divorce from Mae Eleanor Eichenauer with the clerk of the court here today. Cruel and inhuman treatment is charged. They were married October 16, 1941 and lived together until September 15, 1943 according to the Petition. He asks that he not be required to pay alimony.

Mt. Pleasant News – May 4, 1945

MCCAW CHANGES PLEA TO GUILTY

LeRoy McCaw, 24, Winfield was fined $800 or sentenced to not to exceed 8 months in the country jail, when arraigned on a charge of theft of a car before Judge Paul H. McCoid this morning. McCaw changed his plea of not guilty entered last week to a charge of guilty. If he fails to pay the fine, he shall serve the jail sentence. He was still in jail this afternoon.  

McCaw and Gene Arnold of Bloomfield escaped from the state hospital here and were accused of stealing the Carl Totemeier car at New London . They were later arrested near Wapello after the Totemeier car had been wrecked. Arnold was sent to the Eldora Training School .

April 19, 1906 – Mt. Pleasant Court News  

·        John O. Turnwall has brought suit against the Iowa Central railroad for $1990 for personal injuries which he sustained in an accident which occurred the 25th of last July. Mr. Turnwall was driving across the track in a buggy about two miles west of Olds when he was struck by a passing train. His horse was killed and the buggy demolished and he was very badly injured. It is alleged that the whistle was not blown or the bell sounded, and that the company was otherwise negligent by allowing weeds on the high embankment to obstruct the view from the road.  

·        Mary Campbell against Walter M. Campbell: divorce. Plaintiff says they were married in Washington County December 26, 1894 and lived together until March 6, 1906. She alleges cruel treatment as the ground for the divorce and asks for the custody of their two children, both minors and alimony of $50 per month for support. She lives in Jefferson Township .  

*          John and Samuel Wenger against Iowa Central railway. Plaintiffs say that they have a farm of 160 acres in Jefferson township which is crossed by the right of way of said defendant company, and the owing to the negligence of the defendant, a fire was started from sparks from its engines in November 1905 which damaged their meadows to the extent of $62 and again in February, 1906, a like cause damaged them in the same way to the extent of $97.50 for which two amounts they as judgment with interest at 6 percent per annum.

MRS. JENKINS ASKS DIVORCE  

A divorce has been filed in the district court by Mrs. Elma May Jenkins against W. E. Jenkins, a railroad machinist who formerly lived at Burlington but whose whereabouts are now unknown. The plaintiff, who is represented by Mr. James Hourihan, says that she was married to the defendant in Havelock , Nebraska on June 7, 1902 and that they lived together until 1913. At that time the defendant deserted her and although at different times he came back yet in May of this year, he finally deserted her and refused to contribute to her support. Mrs. Jenkins charges him with cruel and inhuman treatment and immoral conduct.  She says that he constantly threatened her, once when in Burlington, striking her on the head with his fist and that in Omaha this last year he threatened to cut her throat. She further says that his immoral associations and conduct are such as to render him unfit to have the care of the minor children of whom there are five:  Paul, age 12; Edith Grace, age 11; Emmeline, age 9; Evaline, age 5; and Everett, age 4. Mrs. Jenkins asks for an absolute decree, the custody and care of the minor children, and the restoration to the rights and privileges of a single person.

COURTS AND LEGAL THINGS  

The grand jury session at Mt. Pleasant last week returned an indictment against Wilbur Wilson of Mt. Pleasant on the charge of obtaining goods under false pretenses. It seems that some time ago, Wilson telephoned the Koch’s shoe store, representing himself to be his brother-in-law living in the country, and offered to stand good for a pair of shoes to be sold to Wilson. Soon after, Wilson call the store thinking it was all right sold him the goods. It is now claimed that the brother-in-law had no conversation with the Koch people in regard to the matter and did not offer to stand good for the shoes. Wilson was suspected of crooked work and his case investigated by the grand jury, which resulted in the indictment found against him.
