The plaintiff is the mother of a boy, ELMER HILL, six years old, and has been divorced from her husband. On Oct. 1, 1899 she signed adoption papers whereby defendant adopted the boy.

It was alleged that defendant whipped the child inhumanely, and without cause or provocation, compelled him to herd cattle during the cold weather, and kept him out doors in the cold. That when the boy was unable to head off the cattle, defendant cruelly beat him and cursed him. She asks that the custody of the child be awarded her. G.W. Baker attorney for plaintiff.

This case was afterwards settled by MILLSAP relinquishing his adoption papers, and the mother given her child.
