In the Circuit Court- April, 1879

James D. Irish vs. Rebecca Drummond- Petition for Appointment of Guardian

The plaintiff states that the defendant Rebecca Drummond is a resident of Van Buren County, Iowa that she has certain property in litigation and dispute as well as some in (_assepia/_resepia) which needs attention and care. That she is of weak and imbecile mind and on account thereof is unable to take care of her property. That on account of such weakness of mind she becomes the easy prey of designing persons who cheat and defraud her out of her property. Wherefore plaintiff asks that she have a Guardian appointed and that said Rebecca Drummond has requested your petitioner to ask for her in that capacity.

To James D. Irish and Rebecca Sallyards or Rebecca Drummond, Administrators of the Estate of John Drummond deceased.

You and each of you are hereby notified that the undersigned heirs of said decedant deny that said Rebecca Sallyards or Drummond is the lawful widow of said decedant, and deny her right to one third or any other part of his estate; and deny her right to administer upon the same, and you are further notified not to deliver any of the property of said estate whether set off by the appraisers of otherwise into the hands or possession of said Rebecca Sallyards or Drummond until her right thereto is determined by a court of competent jurisdiction; and in case you do deliver any such property into the hands or possession of said Rebecca Sallyards or Drummond until her right is so determined, then should she be adjudged not to be entitled.
