SETTLEMENT OF AN ESTATE.
Mr. W. F. Mueller, St. Ansgar, Iowa, My father. Carl Mueller, was married twice. By his first wife he had five children, all of whom are living. By his second wife he had two daughters who are now married, and two sons who are now twenty-five and twenty eight years old, respectively. These two sons have always lived at home and worked there, for no fixed wages, but a living. Their father carried the money and deposits were made in his name. The elder brother did the business, and signed checks, "Carl Mueller, per C. J. Mueller." I am one of the five children by my father's first wife.
My father made no will and died on February 12, 1912. (1) What part of father's estate will the widow get by law? (2) Will the five children by the first wife share equally with the other
four children? (3) Will the two boys mentioned get an extra portion or compensation for the work they did after they became of age? (4) What should be done to effect a settlement of the estate?
Answer.—(1) One Answer.—(1) One-third of the estate, in addition to what is called the
widow's allowance, consisting of household goods, exempt property, etc. -(2) The nine children will share equally in the estate. (3) The two boys will not get an extra share of the property on account of work they did, unless there was an express agreement between them and their father that they should be paid for such work. (4) An administrator of the estate should he appointed by the district court, without delay. The widow or any heir can have this done.
