LANG John Byron: Affidavit re: Estate

AFFIDAVIT DATED June 29, 1956: A. Byron Golberg, being first duly swown on oath depose and state as follows in part: That I was acquainted with John Byron Lang who died on the 15th day of November, 1912, while a resident of and in St. Ansgar, Iowa and was buried in said city.

That the said John Byron Lang died intestate and was survived by his widow, Cora M. Lang, who continued to reside in St. Ansgar, Iowa until the time of her death.

That at the time of his death, the said John Byron Lang was the owner of the following described real estate, to-wit:
Lot No. Eight in Block Seventy-six, in St. Ansgar, Mitchell County, Iowa.

That no probate proceedings were taken out in the estate of the said John Byron Lang, and the above described property, which constituted his homestead, was all of the property left by the deceased. That his burial expenses were paid by his heirs.

That the said John Byron Lang was survived by the following named heirs, who constituted his sole and only heirs-at-law, to-wit: Benjamin H. Lang, a son, and Katherine Rowland Brandau, a daughter, who were children by his first wife Emma Alice Lang, who died on or about the 15th day of January, 1892, and Warner J. Lang, Horace R. Lang, Dayton E. Lang, Eleanor M. Bartholmey and Sarah Jane Flack, who were children by Cora M. Lang, the second wife of the decedent; that no children were born to the said Cora M. Lang, following the death of the said John Bryon Lang.

That the said Benjamin H. Lang died testate in the city of Waterloo, Iowa, on or about the 25th day of October, 1951; that his will was admitted to probate in Black Hawk County, Iowa, and by said will his entire estate was left to his surviving spouse, Emma M. Lang.

That Sarah Jane Flack died intestate in Osage, Iowa, and while a resident of said city, on or about the 6th day of January,1930, and she was survived by her husband, Thomas R. Flack, who was generally known as Reese Flack, and Thomas R. Flack, a son, who was her sole and only heir-at-law; that no probate proceedings were taken out on the estate of the said Sarah Jane Flack, and her entire estate consisted of her undivided interest in and to the above described real estate; that the expenses of her last illness and burial were paid by her heirs.

That Thomas R. Flack, also know as Reese Flack, the surviving husband of Sarah Jane Flack, remarried after the death of the said Sarah Jane Flack, and the name of his second wife was Stella Flack; that the said Thomas R. Flack died in Stockton, California, while a resident of said state, on or about the 4th day of September, 1955, and his body was buried at Osage, Iowa; that his death was generally known in said community, and the expenses of his last illness and burial has been paid by his heirs;
that he died intestate, and his entire estate consisted of an undivided two sixty-thirds interest in the above described estate; that he was survived by his widow, Stella Flack, who now resides in Osage, Iowa, and by his son, Thomas R. Flack, who is his sole and only heir-at-law and resides in Stockton, California.
