AFFIDAVIT: VOIGT

AFFIDAVIT: Jan. 30, 1914.

Carl Gustav Voigt, being first duly sworn, on oath, states: that he is fifty-seven years of age, and has been a citizen and resident of Mitchell County, Iowa, since 1873; that he is the son of Carl Voigt and Wilhelmina Voigt-both now deceased-who conveyed to him by warranty deed dated Aug. 21, 1880, the E 1/2 E 1/2 NW 1/4 and the NE 1/4 SW 1/4-18-98-18, which said deed is recorded in the office of the Recorder of Mitchell County, Iowa, in Book "Z", page 253-"reserving use of house as long as grantors may want it"; that at the time of said conveyance, affiant was living with them in the house mentioned in said deed, and during the fall of 1880 settled with said Carl Voigt and Wilhelmina Voigt and paid them off, and they vacated the same and never returned; that his said father (Carl Voigt) departed this life in Mitchell, Mitchell County, Iowa, on or about Sept. A.D. 1909, and his mother (Wilhelmina Voigt) died in Mitchell, Mitchell County, Iowa, on or about February --, 1907, both having died, intestate.

That affiant was well acquainted with the business affairs of his said father, and knows of his own personal knowledge, that the mortgage mentioned in the deed of his father and mother to Ida E. Voigt, dated Sept. 20. 1880, conveying the W 1/2 E 1/2 NW 1/4 18, 98, 18, and recorded in said office in Book "Z", page 286, as the one "executed by Carl Voigt and wife to
Seigesmond Strehmel, for $400.00 and interest",
was the same identical mortgage as the one given by his said father and mother (Carl Voigt and Wilhelmina Voigt) to Siegesmund Strehmel for $1000.00, dated May 16, 1874, and recorded in said office in Book "F" of Mortgages, page 582-the balance due thereon at date of said deed (Sept. 29, 1880) being $400.00; that affiant knows postively that said mortgage of $1000.00 was the only mortgage ever given by his said father and mother (Carl Voigt and Wilhelmina Voigt) to said Strehmel.

That the mortgage given by his father and mother
(Carl Voigt and Wilhelmina Voigt) to John Sweatt, dated March 19, 1877, and recorded in Book "L" of Mortgages, page 234, was the same identical mortage as mentioned in said deed, dated Sept. 29, 1990-recorded in Book "Z", page 286, which says "Subject to one mortgage executed by Carl Voigt and wife, to John Sweatt for the sum of $220.00", and is the only mortgage ever given by his said father and mother to John Sweatt.

That affiant has no interest whatever in the land described above, and no interest in making this affidavit, except to state the facts as he knows them to be.
