Will Attack Mrs. Martin's Will; Y.M.C.A. and Library Bequests May be Set Aside

Relatives of the late Elizabeth Martin, an account of whose death appeared in Tuesday's Tribune, are planing to resist the probating of her will. The will was filed Monday with Clerk Brothers, but thus far there has been no move made to fix a date for probating the same.

The relatives will seek to have the will set aside on the grounds that Mrs. Martin, at the time the document was drawn, March 7, 1910, was in a feeble condition, and not of a "sound and disposing mind," and that undue influence resulted in her leaving the bulk of the property to public charities.

The main provisions of the will were stated in Tuesday's Tribune. The public bequests were $15,000 to the Glenwood Young Men's Christian Association, $5,000 to the Glenwood Public Library, $4,000 for Martin's Chapel, and $2,000 each to the Omaha Methodist hospital and the Edmundson hospital in Council Bluffs.

The relatives have secured a strong array of legal talent for the purpose of breaking the will, Genung & Genung, General Stone and C.E. Dean.

The will was drawn by Senator Shirley Gillilland, and in the document Judge E.B. Woodruff is named as executor. It will doubtless fall to the lot of these gentlemen to lead in the defense.

Representatives of these various charitable organizations to whom bequests were made will doubtless put up a strong fight against the breaking of the will.

Judge Thornell on Thursday morning granted an order appointing H.A. French of Glenwood as a special administrator of the Martin estate. His bond is fixed at $40,000, and it will be his duties to look after the estate until the probating of the will comes up for consideration.
