AISTROPE, DAVIS, CUNNINGHAM, KILPATRICK, GOODWIN, MULHOLLAND, REED

I, Thomas M. Aistrope, of Malvern, Mills County, State of Iowa, do hereby make and publish this, my last will and testament, hereby revoking and making null and void all other wills and testaments by me herebefore made. All the property, real, personal, or mixed, of which I shall die seized or possessed, or to which I shall be entitled at the time of my decease, I give, devise, bequeath and dispose of in the manner following, to wit:

Par. 1. I direct that my funeral charges and just debts shall first be paid out of my estate by my executor.

Par. 2. I give, devise and bequeath to my daughter, Mary Davis, the south east quarter of the northeast quarter of Section five, and the south west quarter of the north west quarter of Section four, Township Seventy, Rnage Forty-one in Fremont County, Iowa and seven hundred twenty seven and 50/100 dollars in cash.

Par. 3. I give, devise and bequeath to my daughter, Margaret Cunningham, the south thirty acres of the northwest quarter of the north east quarter of Section nine, and the north west quarter of the south west quarter of Section Sixteen, and an undivided one-sixth interest in and to the north one-half of the north east one quarter of Section Seventeen, all in Township Seventy one, Range Forty one, in Mills County, Iowa and four hundred ninety-four and 17/100 Dollars in cash.

Par. 4. I give, devise and bequeath to my daughter, Elizabeth Kilpatrick, the west one-half of the north east quarter of Section Four, Township Seventy, Range Forty-one, in Fremont County, Iowa and undivided one-eighth interest in and to lots five and seven in Section Three, Township Seventy, Range Forty-two, in Fremont County, Iowa as per plat of record, containing ninety-six and 69/100 acres; also an undivided one-eighth interest in and to one lot of one-half acre in extent out of the north east corner of lot one, according to a special plat of record at page 242, of plat book two, of Fremont County records, Iowa; from the foregoing description the following land has been sold to one Bankston and is deducted from the lands described in this paragraph; to wit, the west 397 2/100 of lot seven of the north west quarter of Section Three, Township Seventy, Range Forty-two, in Fremont County, Iowa, containing two and 10/100 acres,

Par. 5. I give, devise and bequeath to my son, Walter G. Aistrope, the North west quarter of the north west quarter of Section Fourteen, Township Seventy-one, Range forty-two, and the north fifteen acres of the south east quarter of the north west quarter of Section twenty-one, Township Seventy-one, Range Forty-one, all in Mills County, Iowa, and one hundred twenty seven and 50/100 Dollars in cash.

Par. 6.. I give, devise and bequeath to my daughter, Sadie Goodwin, an undivided seven-sixteenths interest in and to lots five and seven, in Sec. Three, Township Seventy, Range Forty-two in Fremont County, Iowa, as per plat of record, containing ninety-six and 69/100 acres. Also an undivided seven-sixteenths interest in and to one lot of one-half acre in extent out of the north east corner of lot one, according to a special plat of record at page 242 of plat book two, of Fremont County records, and situated in Section Three, Township Seventy, Range forty-two in Fremont County, Iowa; from the foregoing descriptions the following land has been sold to one Bankston and is deducted from the lands described in the paragraph, to it; the west 397 2/10?t. of lot seven of the north west quarter of Section three, Township Seventy, Range Forty-two in Fremont County, Iowa, containing two and 10/100 acres, and one hundred eighty-one and 25/100 dollars in cash.

Par. 7. I give, devise and bequeath to my son, Thomas Aistrope, an undivided seven-sixteenths interest in and to lots five and seven in Section three, Township Seventy, Range Forty-two, in Fremont County, Iowa, as per plat of record, containing ninety-six and 69/100 acres; also an undivided seven-sixteenths interest in and to one lot of one-half acres in extent, out of the north east corner of lot one, according to a special plat of record at page 242 of the plat book two, of Fremont County records, and situated in Section Three, Township Seventy, Range Forty-two in Fremont County, Iowa; from the foregoing description the following land has been sold to one Bankston and is deducted from the lands described in this paragraph; to wit; the west 397 1/10 ft. of lot seven of the northwest quarter of Section three, Township Seventy, Range forty-two in Fremont County, Iowa, containing two and 10/100 acres, and one hundred eighty-one and 25/100 dollars in cash.

Par. 8.. To my grandsons, Clifford D. Aistrope and William W. Aistrope, I give, devise and bequeath jointly the north east quarter of the south east quarter of Section Twenty –four, Township seventy-one, Range forty-two, in Mills County, Iowa; and seven hundred twenty-seven and 50/100 dollars in cash.

Par. 9.. To my daughter, Anna Mulholland, I give, devise and bequeath the south thirty acres of the north east quarter of the north east quarter of Section nine, and the north east quarter of the north west quarter of Section twenty-one and an undivided one-sixth interest in and to the north one-half of the north east quarter of Section seventeen, all in Township seventy one, Range forty one in Mills County, Iowa, and four hundred ninety four and 17/100 dollars in each

Par 10. To my son Henry Aistrope, I give, devise and bequeath an un-divided two thirds interest in and to the north one half of the north east quarter of Section seventeen, Township seventy-one, Range forty one in Mills County, Iowa and one hundred ninety-four and 17/100 dollars in cash.

Par. 11..To my daughter, Nellie Aistrope, who cared for me during my declining years, I give, devise and bequeath the south one half of the south west quarter of Section seventeen, and the north one half of the north west quarter of Section twenty, all in Township seventy-one, Range forty-one, in Mills County, Iowa; also my residence property in Malvern, Iowa, towit; Lots four, five, six, seven, eight, nine, ten and eleven, in Block six, in Academy Addition to Malvern, Iowa, in Mills County, Iowa, and all furniture, household furnishings, fixtures of whatsoever kind or nature, belonging to and in my residence property.

Par. 12.. To my daughter, Mae Reed, I give, devise and bequeath the east one half of the north west quarter of Section four, Township seventy, Range forty-one, in Fremont County, Iowa, and seven hundred twenty-seven and 50/100 dollars in cash.

Par. 13.. I further direct, after the fulfillment and the foregoing bequests, that the remainder of my property of whatsoever kind or nature, be divided equally among my said heirs in the manner following; one eleventh thereof to my daughter, Mary Davis, one eleventh thereof to my daughter Margaret Cunningham; one eleventh thereof to my daughter, Elizabeth Kilpatrick; one eleventh thereof to my son, Walter G. Aistrope; one eleventh thereof to my daughter Sadie Goodwin; one eleventh thereof to my son, Thomas Aistrope; one eleventh thereof jointly to my grandsons, Clifford D. Aistrope and William W. Aistrope; one eleventh thereof to my daughter Anna Mulholland; one eleventh thereof to my son, Henry Aistrope; one eleventy thereof to my daughter Mae Reed and one eleventh thereof to my daughter Nellie Aistrope.

Par. 14. I nominate and appoint my son, Thomas Aistrope, to be executor of this, my last will and testament (without bond).

Signed by the said testator, Thomas M. Aistrope, as and for his last will and testament in the presence of us, who at his request and in his sight, and presence, and in the presence of each other, have subscribed our names as attesting witnesses hereto, this 20th day of October A.D. 1909
