WILL OF GEORGE H. LINVILLE

I, George H. Linville of the county of Mills in the state of Iowa, being of sound disposing mind and memory and of full age and being desirous of so disposing of my earthly possessions as to me seems proper do hereby make, publish and declare this to be my last will and testament hereby revoking all former wills by me made.

First.. At my death I direct that at my death all just claims and charges against my estate shall be promptly paid out of my personal estate, including all funeral expenses and like charges.

Second..After the payment of my debt and funeral expenses as above specified, I direct that all the remainder of my property of whatsoever kind or nature to wit, (except 30 acres of land hereinafter referred to) shall be converted into money where same can be done at a fair and reasonable price, and from the proceeds of the sale thereof. I direct that there shall be paid to my son Granville P. Linville the sum of One Hundred Dollars. To my daughter, Margaret E. Splawn the sum of Six Hundred Dollars. To my daughter Hester A. Estes, the sum of Six Hundred Dollars. To my grandchildren, H. ? Dye and Willoughby Dye the sum of Three Hundred Dollars each. To my daughter, Nancy C. Wright the sum of Six Hundred Dollars. To my daughter, Sarah ______ Six Hundred Dollars and Martha A. Kelley the sum of Six Hundred Dollars. To my son Lewis G. Linville, I give devise and bequeath (subject to the payment to my estate of the sum of Six Hundred Dollars), the North 30 acres of the South half of the South East quarter of Section 19, Township 72, Range 43.

Third..After the payment of all my debts and funeral expenses as above provided, and after Lewis G. Linville has received his 30 acres of land under the terms and conditions named above and after my children and grandchildren shall have been paid the several sums of money heretofore willed to them and each of them. All the residue and remainder of my estate of any kind and description I direct shall be divided among all my children in equal shares, share and share alike, including in said decision my deceased daughter, Mollie Dye whose share shall be paid to her two children, H. C. Dye and Willoughby Dye in equal shares, share and share alike.

Fourth..In case anyone of my said children dies before I do, I direct that the share that would have gone to such deceased child________ _______ (this line illegible) equally between the children of such deceased child, and if any of my children shall die without issue living at my death, I direct that the share which would have gone to such deceased child shall revert to my estate and be divided equally between my children.

Fifth.. I have made the foregoing distribution of all my property of which I may die seized, upon the basis that in my judgement each and all of my said children by the foregoing distribution will all share alike in my estate , taking into account what I have heretofore given certain ones and this instrument is made upon the basis that equal and exact justice is done to all and in case either one of my children or grandchildren by any means whatsoever or for any purpose whatsoever should be dissatisfied with the provisions herein made and such child or children or grandchild or grand children shall at any time attempt by any legal proceedings whatever to nullify any one or all of the provisions of this will, I direct that the share which under the terms and conditions hereof could go to such child shall revert to and be divided equally between those of my children who stand by and maintain the terms and conditions of this will in its intirety.

Sixth..I hereby designate and appoint Lewis G. Linville, Executor of this my last will and testament and designate P. P. Kelley of Glenwood, Iowa as the legal advisor of my said executor,
and as to bonds for Executor said question is left with court probating this will, dated March 19th 1897. Signed George H. Linville

The foregoing instrument was on the day and date _____, executed by the said George H. Linville in our presence and at the same time he declared the same to be his last will and testament and at his request we signed our names hereto as witnesses both in his presence and in the presence of each other.

I, C. C. Potter Clerk of the District Court, hereby certify that an instrument purporting to be the last will and testament of George H. Linville, late of Mills County, Iowa, was presented and filed on the Eighth day of January 1900.
