January 14, 1981Gregory Enters Not Guilty Plea on Charge
Leonard William Gregory, Jr., 19, Dubuque, entered a not guilty plea Monday morning to a first degree murder charge in the shooting death of Philip Clary, 34, rural Zwingle.
Gregory appeared before District Judge L. D. Carstensen Monday morning accompanied by his court-appointed attorney Thomas Peckosh.
The Dubuque man waived his right to a speedy trial, within 90 days of the hearing.
After consulting both Peckosh and County Attorney Mike Kane, Carstensen set Gregory’s trial to begin 9:30 a.m. Tuesday, April 7.
Carstensen ordered Gregory detained at the Jackson County Detention Center in lieu of $400,000 bail bond. Peckosh requested a bail bond reduction hearing for Tuesday.
Gregory is accused of the Friday, Jan. 2, shooting death of Clary as he and Gregory rode in a car driven by Clayton Manning, Maquoketa.
Manning remains in the Detention Center after authorities revoked his work-release program related to a bad-check charge.
In a sworn affidavit before authorities, Gregory claims Manning promised to pay him $500 and a car to shoot Clary.
The charge of first degree murder is punishable by life imprisonment under the new Iowa Criminal Code.
