Former Cresco Man Dies In Spokane
Clark C. Upton Was Native of Howard County and Prominent Lawyer

Clark C. Upton, a former resident of Cresco and for many years a practicing attorney here, died in Spokane, Wash., Dec. 4. Deceased was a son of the late Judge Upton, a pioneer resident of Howard county. When he first started practice in Cresco he was associated with the late W.K. Barker. The Spokane Spokesman-Review gives the following account of his last illness and sketch of his life:

Death, due to ulcers of the stomach, claimed C.C. Upton Sr., prominent Hillyard attorney, yesterday morning at Sacred Heart hospital following a protracted illness. He was given a blood transfusion Monday morning with his son, Leland B. of Seattle, the donor, and operated upon Tuesday, but life ebbed at 10 a.m. yesterday.

Ill Several Years

It was Mr. Upton's third attack of the stomach ailment. Four years ago he was stricken and recovered, again stricken two years ago to recover, with the attack that caused his death starting last September.

He had been in the hospital for some time and taken home only to be returned Monday in the desperate effort to save him. He had undergone two previous transfusions with another son, Clark C. Upton Jr. of the Federal Land Bank, the donor with both, the family being one of few in which blood came in the same classification.

Mr. Upton was born in Cresco, Iowa, July 19, 1859. His father was one of the first settlers in northeastern Iowa and its first judge.

State University Graduate

Mr. Upton graduated from the University of Iowa in 1889 and was admitted to the bar the same year, and served as city and county attorney in Cresco, and as a member of the state senate during his residence there. He was married to Miss Eva Leland in Cresco in 1893 and they made their home there until 1907, when they moved to Spokane. Here Mr. Upton formed a partnership with the late Judge Hurn and they had their offices in the Hyde building until 1912, when he was appointed city attorney of Hillyard. He then moved to Hillyard, filling this position until Hillyard was annexed to Spokane. He continued to practice in Hillyard and at the time of his death was associated with Georg Elmer Brown in the law firm of Upton & Brown

Active Church Member

He was an active worker in the Westminster Congregational church and a member of the Masonic lodge and the Lions club. In addition to his widow, who survives him at the family home, S1813 Maple, and the two sons, he is also survived by one daughter, Mrs. Gertrude Fortner, Baker, Ore.: two sisters, Mrs. Ada Barker, Spokane, and Mrs. Alma Glass, Washington, D.C.; two nephews, A.J. and E.J. Barker, Spokane, and six grandchildren.
