Sheriff: off-duty deputy followed rules on guns

DES MOINES, Iowa (AP) - Polk County Sheriff Bob Rice said an off-duty sheriff's deputy was within department guidelines when he drank in a tavern while carrying a service revolver.

Investigators say Julius Bryan, 20, of Des Moines, was shot once in the chest during a struggle with Deputy Sheriff James Bennett after the deputy left the tavern. The shooting occurred in the downtown entertainment district about 2 a.m. Wednesday.

Polk County sheriff guidelines state that off-duty deputies may carry firearms that are registered with the sheriff's office, if the deputy has qualified through law enforcement firing-range training.

Rice said Thursday he believes Bennett and John Negrete, the deputy who was with him when he was drinking, were within the bounds of that policy.

Authorities have said they believe Bennett was struggling with Bryan for control of his revolver when he fired the shot that killed Bryan. However, a man who was with Bryan said Bennett and Bryan were 6 to 7 feet apart when the shot was fired.

Rice said the sheriff's review board will investigate the shooting. The investigation, which is expected to be completed within two weeks, is standard procedure when a deputy's weapon is fired, he said.

Rice said the board will issue recommendations, which he will evaluate.
