The case of the state vs. Fred Zugenbuehler was concluded before Justice Carney late yesterday afternoon. Defendant was found guilty of the charge of assault with intent to commit great bodily harm on the person of Arthur L. Cummins, of Company I. of Waukon, and was bound over in the sum of $500 bonds before appearance of the grand jury at its next session.

The testimony offered by the witnesses for the state convinced the court that the assault upon Cummins was unprovoked and that the defendant was wholly to blame in the matter.

Zugenbuehler has but recently returned from the Philippines where he served in the regular army.
