Neglectful in Permitting Spikes
To Become Rusty

Because there was oil and dust on the spikes that he was using and because the said oil and dust caused the spikes to fly up and hit him in the leg, Dennis Sheehan, a section hand, wants $2,000 from the C. B. & Q. Railroad Co.

The petition in which Sheehan sets forth his allegations, is quite humorous. Sheehan, it seems, worked for the railroad last August being employed as a section hand. Among his other duties he was supposed to drive spikes in rails, the company of course furnishing the spikes. One day, Sheehan in driving a spike made a “miskick” and it flew up, striking him in the leg and injuring him severely. Sheehan now alleges that the company was negligent in furnishing him crooked and rusty spikes and that in permitting them to become dirty and oily on the head it showed little foresight and consideration for its employees.
