The last Will and Testament of Joseph D. Wheeler

In the Name of God Amen.

I Joseph D. Wheeler, of Newtown, Fairfield County, Connecticut, being of sound and disposing mind and memory do make and ordain this my last will and Testament in manner and form following to wit:

First. My will is that all my just debts and funeral expenses be paid by my Executer hereinafter named.

Second. I give bequeath and devise to my beloved wife Delia A. Wheeler the use and improvement of all my Estate both real and personal to hold and enjoy the same for and during the full term of her natural life.

Third. I give bequeath and devise the use and improvement of all my said real and personal Estate to my two sons Bradley and George B. Wheeler to hold and enjoy the same after the death of my said wife in equal shares for and during the natural life of each with remainder over to the heirs of each of them.

Lastly. I constitute and appoint my two sons Bradley and George B. Wheeler Executors of this my last will and testament.

In witness whereof I have hereunto set me hand and seal and published and declared this as and for my last will and testament this 11 day of September AD 1855.

Personally appeared David B. Barnum and Henry Sanford and being duly sworn made oath that they were personally present and saw Joseph D. Wheeler sign and seal the foregoing instrument on the day of the date thereof and heard him publish and declare the same to be his last will and testament and that the same was so signed sealed and published in the presence of Amos L. Treat the other subscribing witness thereto, and that they subscribed their names as witnesses to said will in the presence of said Testament and each of each other & in the presence of the other said witness thereto who also subscribed the same in the presence of said testator and in their presence and that they believed said Testator at the time to be of sound and disposing mind and memory.

I, Amos L. Treat, Clerk within and for said Fairfield County, and keeper of the Seal thereof, and of the Commission of Justices of the Peace for said County, hereby certify …..That Amos L. Treat Esq. Was on the 11th day of September 1855 a Justice of the Peace within and for said County, duly appointed, commissioned and sworn having full power and authority by the laws of this State to take the acknowledgements of Deeds and other instruments and to certify the same; also to administer Oaths, to take Affidavits and Depositions out of Court and to give Certificates thereof; that full faith and credit may, and ought to be given to his official acts and attestations.

In testimony whereof I hereunto set my hand and affix the Seal of said County at Bridgeport, in said County and State, on the 10th day of April AD 1857.
