Plymouth Woman Dies After Year's Illness

PLYMOUTH, Oct. 16. - Miss Daisy GRAVES, 38, died in Mason City Tuesday afternoon from rheumatisim. She was born on a farm in Worth county near Plymouth where she lived practically all her life. She has been a sufferer of rheumatism for many a year. Funeral arrangements have not been made, pending word from distant relative.

Plymouth Woman Is Buried in Oakwood

PLYMOUTH, Oct. 18. - Miss Daisy GRAVES, who died Tuesday, Oct. 15, was buried Friday afternoon, with the Rev. William GALBRETH officiating. Burial was made in Oakwood cemetery.

PLYMOUTH BANK IN FOUR ACTIONS FILED BY ONTJES

Cases Outgrowth of Failure of Insitution; Estates Involved.

Four actions naming the defunct Bank of Plymouth and F. G. EHLERS and R. VALENTINE, part owners of the concern, as defendants have been filed in the office of the clerk here by F. J. ONTJES, who represents four groups of plantiffs.

Asa P. GRAVES as the administratior for the estate of his sister, Daisy P. GRAVES, asks the defendants for $1,600.

Mr. GRAVES, as such administrator, and several heirs of Elizabeth GRAVES are also suing the bank and owners for $2,400 based on the deposits placed in the bank during the period from Nov., 1915 to 1925, when the bank was closed. Certificates of deposit were issued for the funds.

The third action is that of the Fidelity and Casualty company against the same defendents for the alleged recovery of $11,690 which it paid as bondsmen for J. H. EHLERS, administrator for the estate of Mary LANGSHADL, on account of the bank's failure and the failure of F. G. EHLERS and R. VALENTINE, as partners and owners of the bank, to pay the amount of the funds of the state deposited and kept by the administrator of the bank.

The fourth case was that of J. F. HOLDEN, who asks judgment for $500 contending that a deposit of $500 in the Bank of Plymouth for Karel DIABEL was assigned to him.

JUDGE EDWARDS GIVES DECISIONS IN TWO ACTIONS

Two decisions both involving questions of transfer of property, were handed down by Judge M. F. EDWARDS Saturday in the district court here.

One decision was for the defendant in the case of Sarah B. O'HALLAN vs. Leonard W. MOTT, Vern MOTT and Anna MOTT, an action that was a sequel to considerable litigation over the J. S. MOTT estate.

The other case involved a claim on the part of a group of depositors in the Bank of Plymouth that R. VALENTINE transferred a farm to his daughter, Mrs. Gertrude HUNTLEY, for the purpose of defrauding creditors.

Four acting involving the same issues were combined into one for this trial, which was heard before Judge EDWARDS the latter part of May.

Held Transfer Void.

The judge held that the transfer of the VALENTINE property to Mrs. HUNTLEY was void. The four plantiffs were given in rem for a total of $7,318.13 with liens against the quarter section farm. The judge held, however, that there was to be no personal judgment agains Mrs. HUNTLEY, all claims as set out inthe four petitions being dismissed except for the judgment in rem against the real estate named.

The case in which Asa P. GRAVES, George GRAVES, Ed GRAVES, Lucille, Ruth, Myron, Harvey, Lloyd Donald and Pearl RUFFRIDGE, and Ray GRAVES were plaintiffs were given judgment in rem for $2,584.98; the case of Asa P. GRAVES, administrator of the estate of Daisy GRAVES, and others, $1,698.43; F. J. HOLDEN $520.71; and M. A. HANSON, $2,514.01.

Held Valentine Partner.

The judge held that Mr. VALENTINE was liable as a partner with F. G. EHLERS in the operation of the bank, altho (sic) the former contended at th trial that he withdrw from the partnership on July 15, 1932. There was insufficient evidence of any public notice of such withdrawal from partnership, if such took place, the judge stated.

In commenting on the claim of the plaintiffs that Mr. VALENTINE transferred the farm to his daughter "without consideration" the judge held that "the general hearing of the evidence indicated fraud altho (sic) no one distinct fact proves it."
