Affidavit, filed July 29, 1943, in Volume 12 of Miscellaneous, Page 532, office of the Recorder of Cedar County, Iowa

I, Hiram J. Donohue, being first duly sworn on oath depose and say that I am 83 years of age and a resident of Cedar County, Iowa, where I have lived for more than 70 years last past.

I further state that William Donohue, one of the grantees in Warranty Deed dated April 28th, 1875, recorded in Deed Record 9, page 585 of the Records in the Recorder’s office of Cedar County, Iowa, and grantee, William Donahue, in Quit Claim Deed dated Aug. 28, 1875, of record in said recorder’s office in Deed Record 10, page 309, and assignee of bond for deed dated May 2, 1868, recorded in book 1 page 312 in said recorder’s office, was my father, and that one of the grantees in Warranty Deed, dated April 28, 1875 recorded in said deed record 9, page 585, Mary Ann Donohue, was my mother; that my said father became deceased on the 1st day of August, 1896, and my said mother became deceased on the 23 day of March, 1920; that at the time of my said mother’s death she was a resident of Cedar County, Iowa, and that at the time of my said father’s death he was a resident of Cedar County, Iowa; that they were never married excepting to each other; that my said father left surviving him at the time of his death, his surviving spouse, Mary Ann Donohue, above named, and the following children and heirs at law, to-wit: John W. Donohue, a son, whose wife’s name was Geneva M. Donohue; Catherine Eliza Donohue Mayes, a daughter who was intermarried with one D. O. Mayes; Thomas H. Donohue, a son, and the affiant herein, Hiram J. Donohue, a son, all of full age; that the said Mary Ann Donohue, my mother aforesaid, at the time of her death left surviving her as her only heirs at law, the said John W. Donohue, Thomas H. Donohue, Catharine Eliza Donohue Mayes, and the affiant herein, Hiram J. Donohue; that my said brother, Thomas H. Donohue, became deceased a resident of Red Oak Montgomery County, Iowa, on the 20th day of October, 1923, leaving surviving him his wife, Ella M. Donohue, two daughters, Mary Maude Ellis and Ruby L. Hoffman, and a son, William N. Donohue, all of full age; that the said Mary Maude Ellis was intermarried with one W. O. Ellis, and the said Ruby Donohue Hoffman was intermarried with one O. A. Hoffman, and the said William N. Donohue was intermarried with one Marie Donohue at the time they conveyed to me their undivided one-fourth interest in and to the Northeast Quarter of Section Thirty-six in Township Eighty-one, North, Range Two, West of the Fifth P.M. on the 9th day of November, 1926, said deed being recorded in Deed Record 73, page 165 in said recorder’s office of Cedar County, Iowa.

Affiant further states that administration was taken out on the estate of the said William Donohue but of not the said Mary Ann Donohue but all funeral expenses and expenses of their last illness were fully paid.

Affiant further states that at all places where the name William Donohue and Mary Ann Donohue appear as stated above it was the correct way to spell the name of Donohue but in other places it appears Donahue but they represent the same persons.

Further affiant sayeth not.
