Last Will and Testament



Last Will of Daniel Tracy

In the name of the Lord Amen.

I, Daniel Tracy of Paint Creek Township in the County of Allamakee and State of Iowa, of the age of 78 and being of sound mind and memory do make publish and disclose this my last will and testament in manner following. That is to say:

First. I set aside one hundred and twenty five dollars for my burial expenses.

Second. I give and bequeath to my wife Hannah Tracy the sum of ten dollars. To my daughter Jane Hart the sum of two hundred dollars. To my daughter Mary Quaney the sum of one hundred dollars. To my daughter Honora Downing the sum of one hundred dollars. To my son Timothy Tracy the sum of two hundred dollars. To my son Daniel Tracy the sum of one hundred dollars. To my son Robert J. Tracy the sum of one hundred dollars. To my son Jas. F. Tracy the sum of three hundred and fifty five dollars. To my son Wm. Tracy, the sum of five dollars. To my son John Tracy the sum of five dollars. Which said several legacies or sums of money I desist and order to bequeath/be- fruid [?] is the said aiapective [?] legatus [?] at the time and date herein specified: To my son Robert J. Tracy the sum of one hundred dollars on the 1st day of January 1885. To my daughter Jane Hart, two hundred dollars on the 1st day of Jan. 1886. To my son Timothy Tracy the sum of two hundred dollars on the 1st day of Jan. 1887. To my son James F. Tracy the sum of two hundred on the 1st day of Jan 1888. To my son Daniel Tracy, the sum of one hundred on the 1st day of Jan 1889. To my daughter Honora Downing the sum of one hundred dollars on the 1st day of Jan 1890. To my daughter Mary Quaney the sum of One Hundred dollars on the 1st day of Jan 1891. To my sons John and Wm. Tracy the sum of five dollars each on the 1st day of Jan 1892. To my son James F. Tracy the sum of one hundred ad fifty five dollars on the first day of Jan 1893. To my wife Hanna Tracy the sum of ten dollars on the 1st day of Jan 1894. Lastly I give and bequeath all the rest residue and remainder of my personal estate goods and chattels of what nature or kind soever to my wife Hanna Tracy. And lastly I do hereby appoint my sons Timothy and Jas. F. Tracy to be the executors of this my last will and testament hereby making all former wills by me made. In witness where of I have hereunto set my hand and seal this 26th day of April in the year of our Lord one thousand eight-hundred and eighty-three.

The above instrument consisting of one sheet was at the date thereof signed and declared by said Daniel Tracy as and for his last-will and testament in presence of us who at his request and in his presence have subscribed our names as witnesses hereto.

Now therefore I do hereby declare this to be a codicile to my said will and testament and to be taken as a part thereof order and declare that when all of the heirs named in the will are paid off that the executors will return to my son Jas. F Tracy all of his natis/debts [?] without interest thereon and cancel the Mortgage I hold against him.
